Job Description
General workers are required to carry out diverse responsibilities related to the production, collection, and packing or processing of vegetable crops. The vegetable warehouse support is for the product that is produced by the employer.
Additional crops can consist of cover crops, hay, and the related job duties as well. The workers will perform their work according to supervisors’ instructions. Must have legal permission to work in the US. Must have three months of positive verifiable previous experience in the job offered. The company may, in its sole discretion, offer raises or bonuses to any seasonal worker employed pursuant to this job order based on individual factors including work performance, skill, and tenure. Workers may be subjected to random, post-accident, and/or upon suspicion drug or alcohol test at no cost to the worker, post hire. Testing positive or failure to comply with the tests may lead to immediate termination from employment.
General Conditions Applicable to All Crops: The work regularly starts at an assigned time shortly after sunrise. The work is performed in varying weather conditions. Workers may drive trucks and carry crops, supplies, tools, or farm workers. All tasks in this job description are one (1) job. The employer may assign workers to different tasks on any day or to multiple tasks during the same day at the sole judgment of the employer.
Workers may be called to perform work on the farm that is incidental to producing the crops such as hand weeding or hoeing, greenhouse cleaning and repairing buildings, maintaining the grounds, operating tractors/farm equipment, crop protection incidental crop setup when needed, and movement of irrigation systems and equipment, gardening, cleaning around ponds & fields. This is a really demanding and competitive business, which requires adherence to quality specifications. Therefore, sloppy work is not allowed and will not be tolerated.
6-8 hours per day is normal. Workers are often scheduled to work longer shifts than the set amount of hours. The employee can be asked but not mandated to work 10-14 hours a day and/or on the Sabbath or Federal holidays based on the conditions in the fields, the weather, and the maturity of the crop. The employer will allocate time for lunch and breaks. The production worker may be put on Saturday and Sunday during peak season and special needs but they will not be obliged. These mandates are relevant to both H-2A and US workers.
Employee working hours may be reduced in the case of excessive heat, cold, or drought. The employer will provide 40 hours a week, depending on the weather and crop conditions. The workers must report to work locations assigned by the employer every day. Furthermore, workers may experience periods of the absence of work due to weather, crop, or some out-of-control issues of the employer. It can be at any point of the season. In general, working hours will be distributed for the tasks of growing vegetables, the processing vegetables, the cover crops-& the hay which will depend on the employers needs. Because the needs of the agricultural sector in production are not known in advance and depend on various factors such as weather, crop growth, market requirements and season jobs, and many other factors, we cannot be sure of what percentage will be allocated to each work task.
If the occupational classification of a locality is found and revised in a new AEWR, and the new AEWR is lower than the rate guaranteed on the job order, then the employer must at least pay the rate that was guaranteed on the job order.
